Idaho Abortion status: Total ban since August 2022 Idaho’s Proposition 1, or the Reproductive Freedom and Privacy Act Initiative, would stop the state from restricting abortion before viability. (It could be restricted at the point of viability, except in cases of medical emergency.) The measure also looks to protect decision-making around pregnancy, childbirth, birth control, fertility treatments and pregnancy loss from the government’s oversight. Restrictions on abortion would still be in place after viability, except when necessary to protect the pregnant person’s life or physical health. Nevada voters will be voting on this measure for the second time — it passed in 2024 with 64 percent of the vote, but the state has a two-election requirement to change its constitution. If passed again, the state supreme court (which has been supportive of abortion rights in the past, per Guttmacher) would then vote for it to take effect. Virginia Abortion status: Legal up to the third trimester, but not protected by state law Virginia’s Question 1 (the Right to Reproductive Freedom Amendment) would establish the right to reproductive freedom in the state constitution. The measure looks to protect the freedom to make personal decisions about prenatal and postpartum care, childbirth, contraception, abortion, pregnancy loss and fertility. It also protects patients, doctor and nurses from being punished for these decisions, or helping others exercise their right to make them. The measure still allows for restrictions on abortion access during the third trimester, except when the pregnant person’s health is at risk or the pregnancy can’t survive. According to data from Guttmacher, over 8,500 people traveled to Virginia from another state for an abortion in 2025 — most of them from the Southeast, where abortion is heavily restricted. Missouri Abortion status: Legal until fetal viability Missouri is the one state this year with an anti-abortion measure on the ballot. The state previously voted to protect abortion rights in the state constitution back in 2024. This year, Amendment 3 (the Prohibit Abortion and Gender Transition Procedures for Minors Amendment) is on the ballot, which would turn back the 2024 vote by prohibiting abortion except in cases of medical emergency, fetal anomaly, rape, or incest.
